Saying it is "based on FOSS" is fine, though. There are also questions about the license agreements required being in violation of the GPL (Full disclosure: the 2nd link is a story covering my blog on the subject). One of the main libraries that differentiates Boxee from XBMC (the Open Source project upon which Boxee is based) is libBoxee.a, which is not open sourced. Yeah, Boxee as a whole is NOT Open Source. Given that, I think it's misleading to call this FOSS at all. It sounds like a substantial portion of what makes Boxee Boxee is not Free/Open Source.
